BIOSTEP Terms of Service Policy
This Terms of Service Policy (“Terms”) is published in compliance of and shall be governed by Indian law, including but not limited to:
(i) The Indian Contract Act, 1872;
(ii) The Information Technology Act, 2000; and the rules, regulations, guidelines and clarifications framed thereunder including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011, and the provisions of Rule 3(1) of the Information Technology (Intermediaries Guidelines) Rules, 2011.
This document is an electronic record in the form of an electronic contract formed under the Information Technology Act, 2000 and rules made thereunder and the amended provisions pertaining to electronic documents/records in various statutes as amended by the Information Technology Act, 2000. This document does not require any physical, electronic, or digital signature.
1. About BIOSTEP and Website Ownership
ABSocare (“BIOSTEP”) is the sole and absolute owner of the brand name “BIOSTEP” and domain www.biostepfootcare.com including any future versions, websites, mobile sites, or mobile applications (collectively referred to as the “Site”).
BIOSTEP respects your privacy and maintains the same as per the Privacy Policy. By accessing or using the Site, you agree to these Terms. If you do not agree to these Terms (without modification), you are advised not to access or use the Site.
Any reference to BIOSTEP in these Terms shall include its agents, officers and employees.
2. Eligibility to Use the Site
You represent and warrant that you are at least thirteen (13) years of age or older, or you are visiting the Site under the supervision of a parent or guardian.
3. Ordering Process
The Site displays a list of varied merchandise and offers for sell, including but not limited to shoes (“Products”) in the territory of India.
All purchases made on the Site are subject to BIOSTEP’s acceptance, which is in its sole discretion. BIOSTEP may refuse to accept or cancel any order, whether or not the order has been confirmed, for any or no reason, without any liability to you or any third party.
Without limiting the foregoing, BIOSTEP reserves the right to refuse or cancel any orders that are to be shipped to any freight forwarding or similar service, whether or not the order has been confirmed.
If your credit/debit card has already been charged for a purchase that is subsequently cancelled, the Site shall issue a credit to your credit/debit card account.
In case a Product appears out of stock, feel free to write to BIOSTEP at the contact information provided in these Terms in order to get notified about re-stocking.
4. Pricing and Payment
The price listed on the Site for the Product is inclusive of applicable taxes. You will be required to pay the final invoiced amount including delivery/handling charges or other additional sums that form part of the final invoice.
BIOSTEP makes every attempt to properly price all Products; however, errors may occasionally occur. Such errors may result in a lower or higher stated price on the Site. BIOSTEP reserves the right to cancel orders which include a pricing or discount error.
5. Intellectual Property Rights
All trademarks, service marks and trade names of BIOSTEP used on the Site (including but not limited to the name BIOSTEP) are owned by ABSocare and are protected under the laws of India.
They may not be used without BIOSTEP’s prior written permission. Any other intellectual property on the Site, including but not limited to patents (issued or pending), are the sole property of BIOSTEP and/or its licensors.
6. Prohibited Use
The entire content included in the Site, including but not limited to text, graphics or code is protected as per the laws of intellectual property rights and other relevant laws of India and is the sole and exclusive property of BIOSTEP.
The contents of the Site can be used solely for non-commercial purposes, or to place an order with the Site or purchase products offered by BIOSTEP.
Any other use, including but not limited to reproduction, distribution, display or transmission of the content of the Site is strictly prohibited unless authorized by BIOSTEP. You further agree not to change or delete any proprietary notice from materials downloaded or printed from the Site.
7. Disclaimer of Warranty
YOU EXPRESSLY UNDERSTAND AND AGREE THAT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: THE SITE, SERVICES AND THE PRODUCTS THEREIN ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTY OF ANY KIND, EXPRESS, IMPLIED, STATUTORY OR OTHERWISE, INCLUDING THE IMPLIED WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.
WITHOUT LIMITING THE FOREGOING, BIOSTEP MAKES NO WARRANTY THAT:
(i) Your requirements will be met or services provided will be uninterrupted or timely;
(ii) Any errors or defects in the Site, services or Products will be corrected;
(iii) The Products offered through the Site shall be exactly as per the images provided on the Site, match the description on the Site, or be fit for consumption.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, BIOSTEP WILL HAVE NO LIABILITY RELATED TO USER CONTENT ARISING UNDER INTELLECTUAL PROPERTY RIGHTS, LIBEL, PRIVACY, PUBLICITY, OBSCENITY OR OTHER LAWS.
BIOSTEP DISCLAIMS ALL LIABILITY WITH RESPECT TO THE MISUSE, LOSS, MODIFICATION OR UNAVAILABILITY OF ANY CONTENT OR PRODUCTS ON THE SITE.
IN NO EVENT SHALL BIOSTEP, ITS OFFICERS, EMPLOYEES, PARTNERS OR SUPPLIERS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY SPECIAL, INCIDENTAL, INDIRECT, CONSEQUENTIAL OR PUNITIVE DAMAGES WHATSOEVER, INCLUDING THOSE RESULTING FROM BREACH OF CONTRACT OR WARRANTY, NEGLIGENCE OR OTHER TORTIOUS ACTION, OR ANY OTHER CLAIM ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR ACCESS TO THE SITE, SERVICES OR PRODUCTS.
THE LIMITATIONS AND EXCLUSIONS IN THIS SECTION APPLY TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.
8. Indemnity
You agree to indemnify, defend, and hold harmless BIOSTEP, its officers, employees, agents, licensors and suppliers from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these Terms or any activity related to your registered account (including negligent or wrongful conduct) by you or any other person accessing the Site using your account.
9. Suspension of Access
BIOSTEP may temporarily suspend access to the Site to diagnose technical issues, improve functionality, implement updates, safeguard security, or comply with any governmental or legal direction.
You acknowledge that during such time the Site may not run at capacity, may become unavailable in certain areas, and/or coverage could be affected.
If you notice any suspicious activity regarding your account or believe your credentials have been compromised, you must notify BIOSTEP at the earliest.
10. Third Party Links
BIOSTEP does not endorse, promote or provide any service qua social media through integration. Third-party links on the Site may direct you to websites that are not affiliated with BIOSTEP.
BIOSTEP is not responsible for evaluating the content or accuracy of third-party materials or websites and shall not be liable for third-party products or services. You should review the third-party’s policies before engaging in any transaction.
11. Returns, Exchange, Refund and Cancellation
11.1 Cancellation Policy
You may request cancellation of an order within 12 hours from the time of placing the order by emailing biostep.help@gmail.com. Refund will be initiated after confirmation of cancellation.
11.2 Exchange Policy
You may exchange shoes in an unworn condition if you have any size issues, want a different shoe style, or do not like the color. All shipping expenses for pickup and replacement will be taken care of by BIOSTEP.
For exchange, please click on “Schedule an Exchange/Return” within 5 days of delivery to receive exchange authorization.
11.3 Return Policy
If a product does not fit you or you want to return it for any reason, you may return the product in unworn condition with packaging intact not later than five (5) days from the date of delivery.
If the product is returned after five (5) days or is worn, damaged, or not in original packaging, BIOSTEP will be unable to honor a refund and the decision of BIOSTEP shall be final and binding.
No return or claim will be acceptable after 5 days from delivery.
11.4 Sale Orders
Orders placed during the Sale period are not eligible for returns. However, if there is a size issue or if the product received is defective or damaged, BIOSTEP will assist with an exchange subject to size availability.
11.5 EMI Orders
Products purchased through EMI are not eligible for returns. However, exchanges are allowed, subject to a limit of one exchange per order and size availability.
11.6 Refund Processing
You will receive confirmation as soon as the returned product is received and payment will be processed within seven (7) business days of receipt of the returned package.
12. Feedback, Reviews and User Content
Any review, submission, feedback, comment or statement posted by you may be displayed publicly on the Site at the sole discretion of BIOSTEP and may not be subject to alteration, modification, or moderation.
You agree that BIOSTEP may use any comments, information or ideas in any communication you send without notice, compensation or acknowledgement.
You may not post or distribute content that BIOSTEP considers abusive, harassing, threatening, defamatory, obscene, impersonating, fraudulent, misleading, violating intellectual property rights, invasive of privacy/publicity rights, illegal, or otherwise objectionable.
13. Force Majeure
BIOSTEP shall not be responsible for delays or failures to fulfil obligations under these Terms due to force majeure events including but not limited to events beyond BIOSTEP’s control, acts of God, traffic disruptions, or unavailability of product.
14. No Third Party Rights
These Terms are made solely for the benefit of you and BIOSTEP and shall not be enforceable by any third party.
15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India.
You irrevocably submit to the exclusive jurisdiction of the courts of Odisha, Bhubaneswar. This does not prevent BIOSTEP from seeking interim relief or injunction in any court of competent jurisdiction.
16. Complaints and Resolution Mechanism
BIOSTEP shall endeavour to resolve complaints or disputes arising from online purchase of Products, technical difficulties, or services received.
Complaints pertaining to Products shall be forwarded to BIOSTEP at biostep.help@gmail.com for review, investigation and response.
You must follow the return process mentioned in Section 11 to claim exchange or refund.
17. NDNC Policy
By using the Site and/or registering yourself at www.biostepfootcare.com, you authorize BIOSTEP to contact you via email or sms and offer services, product knowledge, promotional offers running on the website and offers offered by associated third parties, for which personally identifiable information may be collected.
Irrespective of whether you have registered under DND/DNC/NCPR services, you authorize BIOSTEP to contact you for the above purposes till 365 days of your registration.
During registration, BIOSTEP may collect your first name, last name, contact number, email, Date of Birth and gender. Once registered and signed in, you are not anonymous.
You may also be requested to register your mobile phone and email ID to receive text messages and other alerts. By registration, you authorize BIOSTEP to send sms/email alerts for login details, service requirements and advertising messages/emails.
18. Miscellaneous
By using the Site, you agree to receive electronic communications from BIOSTEP. Any notice or communication sent electronically shall satisfy legal communication requirements.
BIOSTEP’s failure to enforce strict performance shall not be construed as waiver of any provision.
BIOSTEP may assign its rights and duties under this Agreement to any party at any time without notice.
